Retainer Contracts
A retainer is an agreement where a client pays a set fee in advance (monthly, annually, or per matter) in exchange for ongoing legal advice, availability for consultations or representation, or predefined hours of legal work per period.
1. General Retainer
- The client pays to have access to your services when needed
- No specific work is guaranteed - more of a "standby" arrangement
- Ethically riskier, and less common in SA law unless clearly defined
2. Special Retainer (Work-Specific)
- Paid in advance for specific services (e.g. all labour disputes for a company)
- Must include scope, timeframes, and limits
- Preferable from a regulatory and ethical standpoint
